The Ontario Land Tribunal (OLT) has upheld expropriation process that was followed by Frontenac County in 2022 for two parcels of land in the Robertsville area. The parcels, which are partial lots including the K&P trail and a buffer around the trail, will be formally expropriated atr a meeting of Frontenac County Council this week.
In the OLT tribunal report, which was obtained by the Frontenac News in early May and is included as part of this week's agenda, Justice DS Colbourne concludes that the 21 metre width around the trail that the county was seeking is acceptable
In its main finding, the tribunal report says “I am satisfied that ... the taking width is reasonable in view of the overall scope of activities, and the width of the railbed itself.”
Frontenac County Council will be in a position to execute a certificate of approval for the expropriations this week.
One of the parcels was owned by James Riddell, and the other by Rose, David, and Harriett Riddell.
In addition, Council will be considering a staff request to expropriate 4 additional parcels of land in North Frontenac for the purposes of completing the trail through that township. The four new parcels are identified as being owned by the Geddes, Rollo, Sargeant, and Gilchrist families in the Mississippi/Snow Road area.
